By accessing, browsing or using this website, you agree to the terms, conditions and disclaimers herein as amended from time to time. By purchasing an item advertised on this website and/or by completing the registration process to become a member of The Cookie Garden ("a Member"), you agree to be bound by these Terms and Conditions. The Cookie Garden may amend these Terms and Conditions from time to time and any amendment will become effective immediately. Your continued use of this website after amendment constitutes an agreement to abide by and be bound by those Terms and Conditions, as amended.

Trademarks, Copyrights and Restrictions
All material on this site, including, but not limited to images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, and other intellectual property rights which are owned and controlled by The Cookie Garden, its related companies or by other parties that have licensed their material to The Cookie Garden. Material on thecookiegarden.com.au or any Web site owned, operated, licensed or controlled by The Cookie Garden is solely for your personal, non-commercial use. Such material may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by e-mail or other electronic means, without the express prior written consent of The Cookie Garden. Use of the materials on any other Web site or networked computer environment, or use of the materials for any purpose other than personal, non-commercial use is a violation of The Cookie Garden copyrights, trademarks and other proprietary rights, and is prohibited. The use of this website and these conditions shall be governed by and construed in accordance with the laws of Australia. Any legal action arising out of its use shall be brought and enforced under the laws of Australia. By using this site, you agree to submit to the jurisdiction of the courts of Australia and any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Australia.

Fraud
Any party engaged in illegal activities involving the use of this website will be subject to civil and criminal sanctions and prosecution. The Cookie Garden does not guarantee that it will be able to prevent any illegal or inappropriate use of this website, nor that it will give notice of any illegal or inappropriate use of this website. It is an illegal violation to place orders under a false name, with a fraudulently obtained credit card or without the consent of the cardholder. All persons found to have placed a fraudulent order will be prosecuted.

Three Day Return Policy
The entire staff at The Cookie Garden is dedicated to making your experience with us the best one possible. If your gift is damaged during delivery, contact us within three days of receipt of the product and we will immediately replace the item.

Should a problem occur with the personalisation, contact us within three days of receipt of the product. If our artists have made an error, we will immediately replace your gift, or you may send the item back for us to correct the personalisation.

Regretfully, we cannot arrange a resend of a new gift to you if the original gift is disposed of, thereby making them unavailable for us to assess the cause of the problem.

Cancellation of Orders
Should you need to cancel your order, money will be refunded less a $15 administrative fee, ONLY IF notice is received by The Cookie Garden 24 hours prior to the scheduled delivery date. Cancellations received with less than 24 hours notice will be charged at 50% of the total order value. We are unable to cancel orders that are already prepared and are with our courier for delivery.

Refunds
As each cookie gift is unique, so too, are your special requirements and concerns surrounding your order. For that reason, we ask that you please call our Customer Service Department on (07) 3847 8262 to discuss any queries or concerns you may have in relation to your Cookie Garden gift sent or received. A number of resolutions may be available to you and are subject to your particular situation.

Note: All refunds for orders placed online or over the telephone are credited back the original credit card on which the order was purchased.

When do restocking fees apply?
A restocking fee of 35% applies to packages returned to us because an incorrect address was provided, or in the rare instances when all three delivery attempts are unsuccessful. The fee is assessed to cover the shipping charges we accrue when your order is returned to The Cookie Garden.  

Specialty gifts
Specialty gifts may be substituted with another specialty gift of equal or greater value and of similar theme and category.

GST (Goods & Services Tax)
Our products and services attract a Goods and Services Tax (GST) of 10%. All prices advertised are inclusive of all taxes applicable to the respective countries that the product is being delivered in. This is a broad based tax on consumption, which applies to the supply of most goods and services.

Currency
All prices on thecookiegarden.com.au are listed in Australian dollars (AUD).

Alcohol
Any alcoholic products offered for sale by The Cookie Garden are NOT available to persons under the age of 18 years.

Warranty
The Cookie Garden does not warrant that a particular product is available or suitable for your purposes. When necessary, due to limited availability of products from suppliers, The Cookie Garden has the right to make substitutions of products with equal or greater value. Photos depicted are a guideline only. Designs and colours may vary depending on season and supplies. The Cookie Garden does not warrant that your access to the network or the information contained will remain error free, or that the network or the server which stores and delivers the website and its contents to you will remain free of viruses or other harmful components. By accessing the website you agree that The Cookie Garden will not be liable as a result of any error, virus or other harmful component.
